Terms of Service

1. Acceptance of Terms

By accessing or using PicoPixel, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use the service.

2. Description of Service

PicoPixel provides a visual design tool for building embedded user interfaces. The service includes a web-based editor, code export features, and collaboration tools. The platform is currently in beta and is being developed as both a product and a learning exercise. Features, availability, and functionality may change at any time.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

PicoPixel uses third-party OAuth providers (such as Google or GitHub) for authentication. If you need to change your account information, such as your name, email, or profile picture, you must do so through the OAuth provider you used to sign up. PicoPixel does not store or manage passwords.

4. Uploaded Content & Copyright

You are solely responsible for any content you upload to PicoPixel, including but not limited to images, fonts (.ttf, .otf, .woff files), icons, and any other assets. By uploading content, you confirm that you are the rightful copyright holder or have explicit permission to use and distribute that material.

We reserve the right to remove any content that we believe infringes on third-party intellectual property rights, and to suspend or terminate accounts that repeatedly violate this policy.

5. Community Templates & Submissions

When you submit a template, project, or other file to the community templates section so that other users can download and use it, you grant PicoPixel the right to run that submission through multiple virus scanners and security checks before and after it is published. We may use automated and third-party tools to scan, analyze, and verify submissions, and we may decline to publish, remove, or quarantine any submission that fails these checks or that we otherwise consider unsafe.

By submitting a template or project, you affirm that the file does not contain any malware or malicious code and does not infringe on any copyright or other intellectual property rights. You confirm that you are the rightful owner of the submission or have all necessary rights and permissions to distribute it.

You also grant all PicoPixel users a worldwide, non-exclusive, royalty-free license to download, use, modify, and build upon your submitted template or project free of charge, in all matters and for all purposes, including commercial use. This license is irrevocable with respect to copies that other users have already downloaded or used. You retain ownership of your original work, but you may not revoke the rights already granted to others through this section.

6. Prohibited Content

You may not upload, share, or distribute any illegal, illicit, or harmful material through PicoPixel. This includes but is not limited to any form of abuse material, content that promotes violence or terrorism, and any material that violates applicable law.

If we discover or are made aware of such content, we will take the appropriate procedures to remedy the situation, terminate the associated account, and cooperate fully with law enforcement authorities.

7. Acceptable Use & Abuse

You agree to use PicoPixel only for lawful purposes. You may not use the service to infringe on intellectual property rights, distribute harmful content, or interfere with other users' access.

Any attempt to intentionally degrade the platform's performance (such as creating excessive files, projects, or requests designed to overload the service) will result in immediate account suspension or permanent ban. We reserve the right to restrict or terminate access for any user engaging in abusive behavior at our sole discretion.

8. AI, Automated Access & Scanning

If you use AI assistants, agents, or other automated tools to learn about PicoPixel or to help you with PicoPixel-related matters, that access is limited strictly to the public main site at picopixel.io. You are welcome to use AI to read, summarize, or reason over public content on the main site, such as learn articles, documentation, and other informational sections.

AI and automated access must never extend beyond picopixel.io. This includes, but is not limited to, the application and editor at app.picopixel.io and any other subdomain, endpoint, API, or infrastructure. You may not use AI models, agents, bots, crawlers, scrapers, browser automation frameworks, or any other automated means to access, scan, enumerate, probe, or collect data from these areas for any purpose, including browser automation of the app.

You may not enumerate or discover other subdomains, nor use scrapers or other automation to mass download pets, templates, or any other assets. Any user found engaging in prohibited automated access, scanning, or enumeration activity will have their account permanently banned without prior notice. We reserve the right to block access, pursue legal remedies, and report such activity to the appropriate authorities.

9. Enforcement & Account Termination

This applies across the board to all use of the platform, not only to content submitted through community templates. If you submit, upload, or distribute content that is malicious in nature, including but not limited to the deliberate inclusion of copyrighted material, illicit material, malware, or any other artifact that can harm the PicoPixel ecosystem in any way, or if you attempt to hack, exploit, or conduct unauthorized security assessments against the platform, we reserve the right to ban your account immediately and without prior notice.

Where your intent was malicious in nature, no refunds will be issued for any fees you may have paid. We may take these actions at our sole discretion, and we reserve the right to pursue legal remedies and to report such activity to the appropriate authorities.

10. Fees & Subscriptions

PicoPixel offers a generous free tier, and it will stay free. This is not a limited-time beta promotion: the free tier is a permanent part of PicoPixel and will remain available regardless of whether the product is in beta or has reached general availability. Users on the free tier can continue to use PicoPixel free of charge indefinitely for personal, educational, and other non-commercial purposes.

Paid plans are optional and exist for users who need more, such as additional scale and capacity, or the right to use PicoPixel commercially. Commercial use of PicoPixel and of the code you export from it requires a Pro plan or above, as set out in Section 11; the free Community tier and the Starter plan are for non-commercial use only. "Commercial use" here refers to your use of the PicoPixel platform and the projects and code you build with it; it is separate and distinct from the license to use community templates, which is governed by Section 5 and remains free for all users, including for commercial use. You only ever pay if you actively choose to upgrade to a paid plan; you will never be charged simply because PicoPixel leaves beta.

Paid subscriptions are billed in advance and automatically renew at the end of each billing period (for example, monthly or annually) until you cancel. You may cancel at any time. When you cancel, your subscription remains active through the end of the billing period you have already paid for, and you will not be charged for the following period. For example, if you are on an annual plan and cancel, you will continue to have access until the end of that year and will not be billed at the next annual cycle.

All fees are non-refundable, except where a refund is required by applicable law. Canceling does not entitle you to a refund or proration for the remaining unused portion of the current billing period.

We may change our prices or plans from time to time. Any price change will take effect at your next billing cycle, and we will make reasonable efforts to notify you in advance. Prices are exclusive of applicable taxes, which may be added at checkout.

Payments are processed by a third-party payment processor (for example, Stripe). Your use of paid plans is also subject to that processor's terms, and PicoPixel does not store or have access to your full payment card details.

11. Intellectual Property

Your designs and the code you export remain your property. You retain ownership of the original work you create in PicoPixel. PicoPixel retains all rights to the platform, tools, and underlying technology that are original to PicoPixel.

Ownership of your work is separate from the right to use it commercially. Using PicoPixel, and using the code you export from it, for any commercial purpose requires an active paid plan that includes commercial-use rights, currently a Pro plan or above, as described in Section 10 and on our pricing page. The free Community tier and the Starter plan are licensed for personal, educational, evaluation, and other non-commercial use only, and do not grant the right to use PicoPixel or its exported code commercially. Commercial-use rights on paid plans may be subject to revenue thresholds and other conditions set out on our pricing page.

This commercial-use requirement does not affect community templates: as described in Section 5, templates submitted to the community section remain free for all users, including for commercial use.

12. Limitation of Liability

PicoPixel is provided on an "as-is" basis. We make no warranties regarding uptime, accuracy, or fitness for a particular purpose. To the fullest extent permitted by law, PicoPixel shall not be liable for any indirect or consequential damages.

13. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms. We will make reasonable efforts to notify you of significant changes.
